TERMS OF SERVICE

Terms of Service for Mentoring Packages with Adamis Principle Limited

 

This agreement is entered into by Adamis Principle Ltd and (The Provider), You (The User). 

 

Terms & Conditions

1. The Provider agrees in consideration of the fee to make available to the User, the Provider’s Service throughout the term agreed.

2. The Provider shall usually perform the Service during normal hours of operation. The Provider shall use reasonable efforts to inform the User of any delays in the Service.

3. Information published by the Provider, has been obtained from or is based on sources that they believe to be accurate and reliable. Although reasonable care has been taken, the Provider cannot guarantee the accuracy of any information published. Any opinion that the Provider publishes may be wrong and may change at any time and is therefore not liable for inaccurate information.

4. The Provider makes no representation as to the accuracy or completeness of any information provided, and gives no warranty, whether expressed or implied, as to the quality or fitness for a particular purpose of the Service provided.

5. The provider does not accept any liabilities for any losses which are incurred from the User acting or not acting as a result of reading any of the Provider’s publications. The User acknowledges that use of the information is done so at the User’s risk.

6. The User is required to read the Service Level Agreement (see below) and accept all of its terms.

7. The Service Agreement does not permit any replication, duplication, copying or forwarding of any of the publications.

8. This agreement shall be governed by and construed in accordance with English law and each party agrees to submit to the exclusive jurisdiction of the courts of England and Wales.

9. The cost of the package is detailed on the sales page. Pay in full options are a one-off payment and all purchases are final. (Please see below for details about refunds).

You can also choose to pay using a payment plan. These packages are NOT a subscription. 

Please be advised that once you have accepted these terms the Fee is fixed at the price advertised. 

We may increase the Fee for future students. We reserve the right to add additional training modules and to update the programme. Where we do this, we may invite you to upgrade to an enhanced version for an additional fee, but at no time will be any obligation for you to upgrade.

If the price that you pay monthly is higher than the payment in full option, this does not represent a penalty fee but reflects the additional risk and administrative costs to us which are involved when you pay with a payment plan.

In all circumstances, the Fee must be paid in full, even if you decide that you no longer wish to participate. The payment plan is not a subscription which you can opt-out of or cance,l it is designed to make the package more affordable; it is not an option to try before you buy.

If you are paying by instalments and you fall behind on your payments due to an expired card or any other circumstances, we will assist you. Should this happen a second time, we reserve the right to pause your access to the programme materials and live sessions until arrears payments have been settled in full and your account has been brought up-to-date.

Please note: missed payments will be pursued.

10. The terms and conditions of this agreement are confidential between both parties and shall not be disclosed to any other party.

 

Appendix I Service-Level Agreement

Quality of Service

The Provider warrants that the Service will be performed in a professional and dutiful manner consistent with industry standards reasonably applicable to such services. If the User considers that a breach of this warranty has occurred and notifies the Provider in writing, stating the nature of the breach, then the Provider will be required to urgently correct any affected Service in order that they comply with the warranty.

Remedies for Breaches

In the event of any defective performance from the Provider or failure to furnish the agreed level of service, the Provider will make reasonable efforts to restore the Service to a good operating condition on an urgent basis.

Force Majeure

Except in respect of payment liabilities, neither party will be liable for any failure or delay in its performance under this agreement due to reasons beyond its reasonable control. These include acts of war, acts of God, earthquake, flood, riot, embargo, acts of sabotage, government act or failure of the internet, provided the delayed party gives the other party prompt notice of the reasons for such a cause.

Notice of Pausing the Service

Under exceptional circumstances, the user can request a pause in the service of up to 3 months. This is enforced at the management’s discretion.

Cancellation of Service / Refunds

We have a 10 day cooling off period for clients who have not used the service.  Our company policy is that we do not give refunds. 

As you are purchasing digital content which includes data which is produced and supplied in digital form you are only entitled to a refund in limited circumstances. In purchasing the package you are waiving your rights to a refund unless the statutory circumstances for refunds are met.
